Buying a home is an exciting milestone, but in Scotland, the process follows a distinct legal framework. One crucial aspect is the requirement for conveyancing solicitors to handle the legal aspects of the transaction. This guide outlines the key steps involved in purchasing a property in Scotland and highlights the legal requirements to ensure a smooth process.

Step-by-Step Guide to Buying a Home in Scotland1. Arrange Your Finances

Before beginning your property search, assess your budget. If you need a mortgage, obtain a mortgage in principle from a lender, which gives an indication of what you can borrow.

2. Find a Property

Once you have a budget, you can start searching for a home. Estate agents and property websites are great resources. In Scotland, properties are often listed with an Offers Over price, meaning the final selling price could be higher.

3. Request the Home Report

In Scotland, the seller must provide a Home Report, which includes:

  • A property survey
  • An energy performance certificate
  • A property questionnaire This report helps buyers make informed decisions before making an offer.

4. Hire a Conveyancing Solicitor

Scottish law requires that a conveyancing solicitor manages the legal aspects of buying a home. They will:

  • Conduct necessary legal checks
  • Handle the offer submission
  • Draft and review contracts
  • Transfer property ownership

5. Submit a Formal Offer

Your conveyancing solicitor will submit a written offer to the seller’s solicitor. If multiple offers are received, the seller may set a closing date where all bids must be submitted by a deadline.

6. Negotiation and Acceptance

The seller’s solicitor will respond to offers. If your offer is accepted, the solicitors exchange letters known as missives, which outline the contract terms.

7. Finalise the Mortgage

If using a mortgage, provide your lender with the agreed purchase price so they can finalise the loan offer. Your solicitor will ensure the mortgage conditions are met.

8. Concluding the Missives

Once both parties agree to all terms, the missives are concluded, forming a legally binding contract.

9. Settlement and Property Handover

On the agreed settlement date, your solicitor transfers funds to the seller’s solicitor. Once payment is confirmed, you receive the keys, and ownership is officially transferred.

10. Register Ownership

Your conveyancing solicitors will register your ownership with the Registers of Scotland, officially recording you as the new owner of the property.
